1.
AGREEMENT
1.1
These terms and conditions comprise the agreement between SKI NEON Limited ("SKI NEON") and those listed persons listed on the booking form, on whose behalf the group leader has signed to confirm the whole group's acceptance of these terms and conditions (each, a "Guest").
1.2
The "group" refers to all persons booked to stay in Chalet Daguerre (the "Chalet") listed on the booking form, including any changes to the group after the original booking.Back to top ^
2.
BOOKING AND DEPOSIT
2.1
Once availability has been confirmed by SKI NEON, a reservation will be held for five working days, or such other amount of time as SKI NEON may agree, during which time SKI NEON undertakes not to sell the reserved week to a different group.
2.2
A deposit of £100 per person and completed booking form must be received within five working days, or such other period as SKI NEON may agree, from the date of the reservation to confirm the booking.
2.3
If the deposit and completed booking form are not received within five working days, the booking will be deemed cancelled and SKI NEON reserves the right to re-book the week without notification.
2.4
The total balance outstanding on your holiday must be paid in full no later than six weeks before the date of departure.
2.5
In respect of any bookings confirmed after six weeks before the date of departure, the full amount must be paid at the time of booking.
2.6
The first name entered on the booking form will deemed to be the group leader.
2.7
The group leader will be personally liable for all monies outstanding from the remainder of the other Guests in their group.Back to top ^
3.
PRICES
3.1
Unless stated otherwise, the prices stated on the SKI NEON website are for seven nights accommodation, including dinner on 6 nights, breakfast on 7 mornings (with a light breakfast on day of departure if departure is earlier than 9am) and drinks.
3.2
Prices do not include travel to and from the resort, transfers, holiday and medical insurance, ski passes, childcare, equipment hire, ski lessons, lunches and any evening meal taken on the Chalet hosts' night off.
3.3
SKI NEON guarantees the price of the holiday as quoted at the time of booking.
3.4
SKI NEON reserves the right to increase or decrease the price of unsold holidays at any time, notwithstanding that certain beds have been sold for the same week at a different price.
4.
PAYMENT
4.1
The total balance owing to SKI NEON for your holiday must be paid no later than six weeks before your departure.
4.2
If the final balance is not received six weeks prior to the day the holiday commences SKI NEON reserves the right to cancel the booking and any deposits paid will be forfeited.
4.3
SKI NEON then reserves the right to re-book the Chalet without further notice.
4.4
Every effort will be made to contact clients to remind them of payment dates.
4.5
Preferred payment types are:
  1. Telegraphic transfer (any charge for which to be incurred by the client)
  2. Cheque made payable to SKI NEON Ltd
  3. Credit card (Visa or Mastercard only), subject to prior arrangement with SKI NEON.
4.6
Late payment of your final balance that incurs any charges or loss of revenue on the part of SKI NEON will be added to your balance. This does not affect your booking.Back to top ^
5.
CANCELLATION BY SKI NEON
5.1
If, through circumstances beyond our control, SKI NEON is forced to cancel your holiday, a full refund is payable. This does not include cancellation resulting from events or circumstances amounting to force majeure (being war, political unrest, weather, strikes, acts of God, epidemics, riots, civil strife, industrial disputes, terrorist activity, natural or technical disasters) or if the client defaults in the payment of the final balance of the holiday cost.Back to top ^
6.
CANCELLATION BY CLIENT
6.1
You, or any member of your party, may cancel your holiday at any time providing that the cancellation is made in writing by the person listed on the booking form as the group leader.
6.2
SKI NEON takes no responsibility for non-delivery or non-receipt of the written cancellation.
6.3
If you cancel your holiday before your date of departure, you will forfeit the following amounts, according to how long before your departure you cancel:
  1. More than 8 weeks before departure: Deposit.
  2. 8 weeks to 4 weeks before departure: 50% of total amount payable for your holiday.
  3. 4 weeks to 2 weeks before departure: 75% of total amount payable for your holiday.
  4. Less than 2 weeks before departure: 100% of the total amount payable for your holiday.
6.4
Non-receipt of the balance on the total cost of the holiday will not be taken as notification of cancellation; clients will still be liable for cancellation charges as shown above if they subsequently cancel the holiday.Back to top ^
7.
LIMITATION OF LIABILITY
7.1
With the exception of death or personal injury of Guests, SKI NEON's liability is limited to the invoiced holiday cost and under no circumstances extends to the additional costs incurred by Guests in taking the holiday such as, without limitation, travel to and from the resort, pre-booked services, tuition or ski passes.
7.2
Nothing in these terms and conditions is intended to exclude or limit the liability of SKI NEON for death or personal injury arising from negligence or for loss arising from negligent misrepresentation or fraud. Back to top ^
8.
CHILDREN
8.1
Children are welcomed at SKI NEON, and we will do what we can to make parent's holidays as easy and stree-free as possible. Please advise of any special requirements (e.g. cots) when booking.
8.2
Children under 12 years old receive a 10% reduction on the published price of the holiday.
8.3
Children under 2 years old pay £50 if they occupy their parents' room.
8.4
For whole Chalet bookings, children may eat with adults at the main meal time, or may take a "high tea" to be served at about 6.30-7pm, at the discretion of the parents.
8.5
For groups with children who do not book the whole Chalet, SKI NEON reserves the right to require children under 12 years old to take a "high tea" at about 6.30-7pm in order to ensure the enjoyment of the meal by all occupants of the Chalet.Back to top ^
9.
WHOLE CHALET AND GROUP BOOKINGS
9.1
The Chalet must be taken on a whole Chalet booking basis only (part bookings may only be accepted at the discretion of SKI NEON).
9.2
Any empty beds, except in the den room, will be charged at full price.
9.3
If, for any reason, part of the group cancels, the whole Chalet booking price still stands and must be paid by the remaining member of the group. If the group does not wish to pay the whole Chalet price the Chalet booking will be deemed cancelled and cancellation charges as set out in these terms and conditions will apply for the whole Chalet. SKI NEON also reserves the right to re-sell the holiday without further notification.
9.4
SKI NEON also reserves the right to have other parties stay in the Chalet unless the whole Chalet is taken and paid for.Back to top ^
10.
RESPONSIBILITY AND BEHAVIOUR
10.1
Damage by any Guest to the Chalet or its grounds, fixtures, fittings or furniture must be paid for in full at the time of the incident by way of cash settlement.
10.2
Guests are requested to be considerate to other occupants of the Chalet and the surrounding chalets and keep excessive noise to a minimum, particularly late at night.
10.3
Persons wishing to enter the Chalet who have not booked holidays with SKI NEON are only permitted to do so with the prior consent of SKI NEON, and SKI NEON staff must be present at all times during the visits of such persons, and under no circumstances will any liability in relation to any such person be accepted by SKI NEON.
10.4
Any Guest who is persistently in breach of these terms and conditions may have their holiday and SKI NEON's responsibility towards them terminated immediately.Back to top ^
11.
GUEST COMPLAINTS
11.1
We hope you will not have cause to complain. Should you do so, please complain immediately to any member of the SKI NEON staff.
11.2
No complaints can be accepted for snow conditions, weather, closures of ski lifts and lack of ski/snowbaord hosting caused by injury, sickness or shortage of staff.Back to top ^
12.
HOT TUB & SAUNA
12.1
Guests should adhere to the rules and regulations regarding the hot tub and sauna, a full description of which can be found in the Chalet.
12.2
Children under the age of 12 are not permitted in the hot tub or sauna; children between the ages of 12-17 must be accompanied by an adult at all times when using the hot tub or sauna.
12.3
SKI NEON reserves the right to carry out any maintenance and draining / refilling needed that might render the hot tub or sauna unusable to ensure all health and safety regulations are met.Back to top ^
13.
THIRD PARTY ACTIVITIES
13.1
SKI NEON is happy to help Guests arrange extra services and activities during their holidays.
13.2
These services are subject to the terms and conditions of the individual suppliers, companies or operators offering these services and our help in making arrangements does not constitute an approval and we take no responsibility or liability for these services.
13.3
Any grievance with a third party service should be taken up with the provider and client directly.Back to top ^
14.
LOST AND STOLEN PROPERTY
14.1
In the event that any Guest loses or leaves any items in the Chalet, no responsibility will be accepted by SKI NEON if the property is not recovered or returned.
14.2
SKI NEON cannot accept any responsibility for theft either from the Chalet or at any other time during your holiday.
14.3
Any client not properly securing the exits and windows after leaving the Chalet will be liable to any property taken as a result of that negligence. Back to top ^
15.
SKI/SNOWBOARD HOSTING
15.1
During your stay you have the option of using our free ski/snowbaord hosting service, on such number of days as SKI NEON and the Guests agree between them. Ski/snowboard hosting comprises map orientation, accompanied skiing and snowboarding and providing advice and recommendations as to the best mountain retaurants and bars in the Trois Vallees ski area.
15.2
Under no circumstances will our hosts offer out-bound or off-piste guiding and if you choose to do this whilst in the company of a host you will be strongly advised against any such action unless you employ a professional mountain guide and the appropriate equipment, and the ski/snowboard hosting will be deemed to end immediately upon a Guest engaging in any out-bound or off-piste skiing or snowboarding.
15.3
We reserve the right at our absolute discretion to terminate without notice and liability ski/snowboard hosting for a group or any Guest whose behaviour is such that is likely, in our opinion or the opinion of a ski lift operator or ski guide or other person in authority to cause distress, danger, damage or annoyance to other customers, employees, property or to any third party.
15.4
The ski/snowboard hosting service offered by SKI NEON applies to the Three Valleys ski area only and is available to Guests of SKI NEON only.
15.5
This service is not ski or snowbaord guiding, nor is it ski instruction of any sort and Guests availing themselves of the ski/snowboard companion service are asked to avoid asking for any kind of instruction from their ski/snowboard host(s).
15.6
This service may be withdrawn without prior notice at any time by SKI NEON.Back to top ^
16.
ARRIVAL AND DEPARTURE TIMES
16.1
The Chalets will be available to incoming Guests after 3pm on day of arrival, although we will endeavour to have the Chalet ready earlier if previously requested for and agreed by SKI NEON.
16.2
The Chalet must be vacated on day of departure by 10am in order to allow for cleaning.Back to top ^
17.
OUTDOOR SHOES
17.1
Outdoor shoes, ski boots and snowboard boots are strictly prohibitted in the Chalet as they damage the floors. Please use soft shoes or slippers when in the Chalet.Back to top ^
18.
SMOKING
18.1
Smoking is strictly prohibited in the Chalet, although there is a large covered balcony with ash trays for you to use.Back to top ^
19.
CHILDREN
19.1
SKI NEON will not be held responsible for any accidents occurring within the Chalet.
19.2
It is the parent or guardian's responsibility to ensure their children are supervised at all times when in the Chalet.Back to top ^
20.
DIETARY REQUIREMENTS
20.1
Please inform SKI NEON of any special dietary requirements when making your reservation or booking.

Every effort will be made to accommodate dietary requirements of Guests.Back to top ^
21.
TRAVEL INSURANCE
21.1
Skiing can be dangerous. Everyone booking a SKI NEON holiday and partaking in any winter sport must be fully insured with a suitable winter sports travel insurance policy.
21.2
We reserve the right to ask for proof of travel insurance upon your arrival at the Chalet and, if you are found to have insufficient cover you will be obliged to purchase a suitable insurance policy.
21.3
We may be able to help Guests identify suitable winter sports insurers on request.
21.4
SKI NEON will not be liable for any loss occasioned to either party arising out of any contract enetered into between a Guest and any insurance company Back to top ^
22.
GOVERNING LAW AND JURISDICTION
22.1
These terms and conditions and the agreement between SKI NEON and the Guest and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the law of England and Wales.
22.2
The parties irrevocably agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim that arises out of or in connection with these terms and conditions and the agreement between SKI NEON and the Guest or their subject matter or formation (including non-contractual disputes or claims).
22.3
We have tried to be entirely accurate will all information given but cannot be held responsible for inaccuracies.
22.4
If there are any changes to any of the information we have provided, we will notify you when you book. Back to top ^
